Elemental Health & Nutrition (we, us, our) operates a nutritional-medicine practice and the website at elementalhealthandnutrition.com.au, and provides patients with secure online access to their results at reports.elementalhealthandnutrition.com.au. We are committed to protecting your privacy and handling your personal and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because our work involves your health, much of the information we hold is “sensitive information” under the Privacy Act and is given a higher level of protection.

The information we collect

• Contact and identity information — name, email, phone, location, and details you provide when you enquire, book, or become a patient.
• Health information (sensitive information) — your health history, symptoms, lifestyle, medications and supplements, and the information you share during consultations and in questionnaires.
• Pathology and functional test results — blood, urine, stool, epigenetic (biological age) and related test results ordered as part of your care.
• Payment information — processed by our payment provider; we do not store your full card details.
• Website usage information — cookies and analytics when you use our website (see “Cookies and our website” below).

How we collect it

We collect information directly from you (enquiry forms, calls, questionnaires, email) and from pathology and functional-testing laboratories that process your samples on our instruction. Where it is reasonable and practicable, we collect information directly from you.

Why we collect and use it

We use your information to:

• assess whether our care is appropriate for you;
• provide your care — interpret your results, build and adjust your plan, prepare your results reports, and support you between consultations;
• communicate with you about your care;
• arrange testing and, where relevant, coordinate with your GP or other practitioners with your consent;
• process payments and administer your file;
• meet our legal and professional obligations.

We only collect health (sensitive) information with your consent, and we use it only for the purposes for which it was collected, or a directly related purpose you would reasonably expect.

When we disclose it

We do not sell your information. We disclose it only where necessary to deliver your care or run the practice, including to:

• pathology and functional-testing laboratories engaged to process your tests;
• your GP or other treating practitioners, with your consent — for example, where your results point to something that belongs with a doctor, we provide a written brief;
• service providers who help us operate (for example, secure scheduling, email, practice, payment, and the encrypted results-hosting service described below), who are bound to protect your information;
• others where required or authorised by law.

Your online results link

Where we give you an online link to your results, your report is a private page reachable only through a unique, unlisted link we send you, and opened with a personal code (your year of birth). Your report is encrypted on our system before it is stored, so the hosting service holds only an encrypted file and cannot read your results. The page is marked so that search engines do not index it. You can ask us to disable your link at any time, and links are, in any case, removed when they are no longer needed (see “How we store and protect it”).

Overseas disclosure

Some functional tests are processed by laboratories located outside Australia, including in the United States (for example, epigenetic biological-age and certain hormone tests). In addition, the encrypted online results described above are hosted through a content-delivery network whose servers may be located overseas, including in the United States; because the report is encrypted before it leaves our system, the hosting provider stores only an encrypted file and cannot read your results. Where your information is processed or stored overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles. By consenting to these tests and to receiving your results online, you consent to this overseas disclosure.

How we store and protect it

We hold your information in secure electronic systems and take reasonable steps to protect it from misuse, loss, and unauthorised access, modification or disclosure. Access is limited to your practitioner. Where you are given an online results link, the report is encrypted before storage, served only over a secure (HTTPS) connection, and not indexed by search engines; online links are removed 12 months after your report is last updated, or earlier at your request. We retain your clinical health records for the period required by law and our professional obligations, and securely destroy or de-identify information when it is no longer needed.

Accessing and correcting your information

You may request access to the personal and health information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Contact us at rohan@elementalhealthandnutrition.com.au. We will respond within a reasonable time. In limited circumstances we may need to decline access, and we will explain why.

Our website uses cookies and similar technologies to function and to understand how it is used. You can manage your preferences through the consent tool on the site and your browser settings.

Complaints

If you have a concern about how we have handled your information, please contact us first at rohan@elementalhealthandnutrition.com.au and we will work to resolve it. If you are not satisfied, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

We may update this policy from time to time. The current version is always available on this page, with the effective date shown above.
